Objective Semiotica is published in six annual issues, in two languages (English and French). From time to time, Special Issues, devoted to topics of particular interest, are assembled by Guest Editors. The publishers of Semiotica offer an annual prize, the Mouton d'Or, to the author of the best article each year. The article is selected by an independent international jury. Topics We welcome papers reporting results of research in all branches of semiotic studies. The judges commented: "The Committee members made this decision based on many appreciations. First, the article contains a concise theory on semiotics of movement, synthesizing decades of research of the author. It opens an exciting framework for the contribution of many other authors. The theoretical grounds of semiotircity are built on the most classical semiotic approaches and represent a genuine development. Second, the article refreshes semiotics methodology in very original way, by engaging the applied semiotics for furtive and instantaneous activities analysis. Third, the article is pretty clear and well structured, written in very comprehensible French. The theoretical frame it opens is thorough and far reaching. Fourth, the semiotic theory of movement comes in a very special moment when the whole world is football, but it covers also many other areas of applicability which reflect major trends such as the general gamification of life thanks to new media and digital technologies. It is crucial for semiotic theory to open its theoretic scope towards significant cultural trends and become more attractive for young researchers." Les membres du comité ont pris leur décision en fondant leur appréciation sur quatre éléments principaux. Premier élément : l'article, en peu de mots, en prenant appui sur des décennies de recherche de la part de l'auteur, déploie de manière précise les termes d'une sémiotique du mouvement. Les fondements théoriques de la sémiotricité sont construits sur des approches sémiotiques bien établies et représentent un véritable développement dans le domaine. En cela, le texte ouvre un cadre passionnant pour les contributions de nombreux autres chercheurs. Deuxièmement, l'article renouvelle la sémiotique appliquée de manière très originale, l'engageant dans une approche efficace des actions instantanées et furtives; la méthodologie sémiotique en général en tire donc aussi profit. Troisième point, en plus d'être profond, avec un cadre théorique d'ampleur et de grande portée, l'article est particulièrement bien structuré et écrit dans un français très compréhensible, ce qui est un véritable gain pour sa diffusion. Enfin, quatrièmement, s'il est indéniable que le texte pourrait bénéficier d'une visibilité complémentaire due à la ferveur liée au contexte récent de la coupe du monde de football au Qatar, il couvre surtout de nombreux autres domaines d'applicabilité qui reflètent des tendances majeures telles que la gamification générale de la vie, portée par les nouveaux médias et les technologies numériques. L'on y voit une belle opportunité pour la théorie sémiotique d'ouvrir son champ à la faveur de tendances culturelles significatives; ceci est une garantie pour continuer à attirer de nouvelles générations de chercheurs. What happens when collectivity and law intersect? Lisa Hahn and Markus Hasl outline the state of research on this question and add new answers offered by this special issue. On the one hand, the search for interdisciplinary encounters shows that law is both means and object of collective legal struggles. In doing so, collectives shape law. On the other hand, law (re)produces collectives through categorization and personalization; it juridifies. In doing so, it oscillates between productivity and destructiveness. (...) Social enterprises, like almost all organizations, continuously strive for external legitimacy. To be perceived as externally legitimated by society, social enterprises often engage in strategic partnerships. However, scholars have only recently turned their attention to the legitimating function of such partnerships. The purpose of this article is to address the hitherto neglected construct of inter-partner legitimacy. Drawing on institutional theory, we hypothesize that such inter-partner legitimacy affects the resource transfer among partners, which will, in turn, be recognized by society (...) and will subsequently affect each partner’s external legitimacy. Dyadic data of 121 strategic partnerships between social enterprises and their key partners confirm our hypotheses. We add to institutional theory by integrating the often ignored dimension of inter-partner legitimacy into our analysis and demonstrate its relevance to each partner’s external legitimacy and to resource transfer. Further contributions to the literature on institutional theory, legitimacy, social entrepreneurship, and inter-organizational relationships are identified. (shrink)

The powerhouses of old, such (...) as the Peirce Edition Project at Indiana University and the Institute for Studies in Pragmaticism at Texas Tech University, appear pretty much dead in the water. And this new center of gravity is by no means limited to secondary literature. Bellucci's edition of Peirce's writings on semiotics and Pietarinen's multi-volume Logic of the Future present us with well-thought-out and responsibly edited volumes of primary literature that will leave their mark on Peirce scholarship for decades to come. And there are other volumes on the way.Bellucci's volume spans almost two decades of Peirce's life—a period during which Peirce had retreated to Milford, Pennsylvania, spending most of his time with his pen on paper. The main purpose of Bellucci's volume is to give us better access to material that has not yet been published—material that is, as Bellucci contends, "essential to understand Peirce's views about signs, their classification, and the relations between semiotics and logical inquiry" (p.1).In line with this, Bellucci starts off where the Writings break off. The last volume of the Writings, which appeared well over a decade ago, ends midway 1892, and Bellucci's volume opens with the sixth chapter of Peirce's 1894 logic book How to Reason, "The Essence of Reasoning." Bellucci thereby skips the second chapter of that same logic book, even though it deals directly with the question "What is a Sign?" He does this on the ground that that chapter is already published in the second [End Page 265] volume of The Essential Peirce (p.3). Bellucci's Selected Writings on Semiotics is thus best considered a professional tool aimed at filling gaps in the literature for Peirce scholars who are already familiar with, or knowledgeable of, what is already out there. Making these texts available is especially important since the manuscripts they are based on are not widely accessible and are in various states of disarray.Each text in Bellucci's volume comes with a (sometimes-extensive) editorial note that is largely bibliographical and, like the Writings, explains which manuscript sheets constitute the text by supplementing the Robin Catalogue designation with the page reference system devised by the Institute for Studies in Pragmaticism. The headnote is followed by explanatory annotations, emendations, and alterations, not unlike the system used for the Writings. In this way the reader can easily ascertain where Bellucci made corrections to the original text and what changes Peirce made himself when he was in the process of writing. Putting the apparatus immediately following each text is a much better choice than hiding everything in the back of the volume, as was done in the Writings. Given the nature of this edition, however, it would have been better to have the editorial note precede the text, as is done, for instance in The Essential Peirce, rather than follow it (or use two notes), as that would have made it easier for the reader to position the text within Peirce's oeuvre before beginning to read it (for instance, by reading "What is a Sign?" before starting "The Essence of Reasoning").Bellucci's Selected Writings on Semiotics includes eighteen selections in total, each of which is described briefly in the volume's Introduction with a rationale for including it. As with the Writings, titles not given by Peirce are printed in italic square brackets. At times a more forceful editorial hand in establishing the titles themselves would have been helpful. Corporate social responsibility in developing countries has recently received increasing attention, and scholars have pointed to the strong contextuality of CSR in the respective regions. Regarding the latter, however, sub-Saharan Africa has been scrutinized only marginally by academia. Moreover, empirical research on the impact of the institutional context has been scant, despite its attributed importance for CSR. Our article seeks to fill a part of this research gap by investigating CSR website reporting of 211 companies in seven sub-Saharan countries. (...) The study’s aim is twofold: First, we identify to what extent sub-Saharan companies report on CSR and which contents they disclose. Second, by building on institutional theory, we investigate how the socio-economic and political environments influence CSR reporting. For this purpose, we examine the impact of country-level and company-level determinants. We find that the sample African companies’ CSR efforts focus strongly on local philanthropy and therefore differ substantially from Western CSR approaches. Furthermore, we evidence that GDP and level of governance standard positively affect CSR reporting. Our study contributes to the literature by empirically evidencing the contextuality of CSR in Africa and by explaining how specific country- and company-level determinants contribute to or hamper the development of CSR in developing countries. Purpose Employees may feel overwhelmed with information privacy choices and have difficulties understanding what they are committing to in the digital workplace. This paper aims to analyze the role of different thinking styles for effort reduction, such as the use of intuition, when employees make decisions about the credibility and trustworthiness of workplace information privacy issues in Slovakia. While the General Data Protection Regulation sets precise requirements for valid consent, organizations are classified as data controllers and are subject to (...) credibility judgments by their employees. Design/methodology/approach Data was collected from 230 employees in Slovakia using a survey questionnaire. Quantitative analysis using SPSS was conducted to describe employees thinking preferences when judging the credibility of information privacy in their organizations. Findings The survey participants revealed their perceived credibility and trust in personal data protection and thinking preferences. Unconscious thinking is the type of effort reduction often reported by participants, who perceive high credibility and trust in personal data protection. This study can help managers and data controllers in small- and medium-sized enterprises in reflecting about the way in which people use different thinking processes for decision-making about information privacy in their organizations. Research limitations/implications This study set out to explore how decision-making processes at the workplace relate to credibility of data practices. Focusing on the use of different types of intuition, the authors explored whether the preference for a specific decision-making style can explain the perceived credibility of data practices. The part of the workforce in the sample did not have a strict predisposition to use either intuitive or rational thinking. Practical implications The contribution provides scholars with an overview of the field of intuition, a field that is likely to grow given the challenges of digitalization for organizations, such as shitstorms, cyberattacks and whistleblowing. Originality/value The most well-known concepts from intuition research, e.g. the dual process theory, and practice are tested simultaneously, therewith contributing to the applied literature on domain-specific preferences for intuition and deliberation in decision-making. ABSTRACT:The profound influence of Thomas Donaldson and Thomas Dunfee’s integrative social contracts theory on the field of business ethics has been challenged by Andreas Scherer and Guido Palazzo’s Habermasian approach, which has achieved prominence of late with articles that expressly question the defensibility of ISCT’s hypernorms. This article builds on recent efforts by Donaldson and Scherer to bridge their accounts by providing discursive foundations to the hypernorms at the heart of the ISCT framework. Extending prior literature, we propose (...) an ISCT* framework designed to retain ISCT’s practical virtue of managerial guidance while answering the demands of Scherer and Palazzo’s discursive account. By subscribing to a suitable portfolio of discursively justified hypernorms, we argue, companies unlock the valuable moral guidance of ISCT*, which says to treat these hypernorms as unequivocal outer bounds to the pursuit of business and as a starting point to tailor local norms through discursive stakeholder engagement. BackgroundDouble-blind peer review has been proposed as a possible solution to avoid implicit referee bias in academic publishing. The aims of this study are to analyse the demographics of corresponding authors choosing double-blind peer review and to identify differences in the editorial outcome of manuscripts depending on their review model.MethodsData includes 128,454 manuscripts received between March 2015 and February 2017 by 25 Nature-branded journals. We investigated the uptake of double-blind review in relation to journal tier, as well as gender, (...) country, and institutional prestige of the corresponding author. We then studied the manuscripts’ editorial outcome in relation to review model and author’s characteristics. The gender (male, female, or NA) of the corresponding authors was determined from their first name using a third-party service (Gender API). The prestige of the corresponding author’s institutions was measured from the data of the Global Research Identifier Database (GRID) by dividing institutions in three prestige groups with reference to the 2016 Times Higher Education (THE) ranking. We employed descriptive statistics for data exploration, and we tested our hypotheses using Pearson’s chi-square and binomial tests. We also performed logistic regression modelling with author update, out-to-review, and acceptance as response, and journal tier, author gender, author country, and institution as predictors.ResultsAuthor uptake for double-blind submissions was 12% (12,631 out of 106,373). We found a small but significant association between journal tier and review type (p value < 0.001, Cramer’s V = 0.054, df = 2). We had gender information for 50,533 corresponding authors and found no statistically significant difference in the distribution of peer review model between males and females (p value = 0.6179). We had 58,920 records with normalised institutions and a THE rank, and we found that corresponding authors from the less prestigious institutions are more likely to choose double-blind review (p value < 0.001, df = 2, Cramer’s V = 0.106). In the ten countries with the highest number of submissions, we found a large significant association between country and review type (p value < 0.001, df = 10, Cramer’s V = 0.189). The outcome both at first decision and post review is significantly more negative (i.e. a higher likelihood for rejection) for double-blind than single-blind papers (p value < 0.001, df = 1, Cramer’s V = 0.112 for first decision; p value < 0.001; df = 1, Cramer’s V = 0.082 for post-review decision).ConclusionsThe proportion of authors that choose double-blind review is higher when they submit to more prestigious journals, they are affiliated with less prestigious institutions, or they are from specific countries; the double-blind option is also linked to less successful editorial outcomes. The book carefully details the settler- colonial ideology and logic of elimination that permeated US territorial expansion over the Northwest Territories at the end of the eighteen and the first decades of the nineteenth centuries. Seeing Red thoroughly examines the complex context of dispossession by the US colonial power, centering on Anishinaabeg communities, the “mix- race” population, and the different Indigenous people inhabiting this region. However, the book focuses on what the author names “unthinkable history,” following Michel- Rolph Trouillot’s argument that this region, and the whole continent, was conceived as an unsettled territory instead of belonging to many Indigenous peoples. Thus, the text explores Indigenous and mixed- raced communities’ political imaginaries and imagined futures to retain autonomy and territory.Author Michael John Witgen is a citizen of the Red Cliff Band of Lake Superior Ojibwe and a professor in the Department of History and the Center for the Study of Ethnicity and Race at Columbia University. His research centers on the complex relations between Indigenous people and settler colonizers in the Great Lakes and the Northwest Territories. Seeing Red expands his previous analysis of race, ethnicity, and citizenship intersections, bringing to the fore Indigenous people’s history to rethink the statemaking process in the United States.This book’s pages show that theft lies at the foundation of wealth transfer from Indigenous territories to the United States government and white citizens. The white settler ideology, based on a “doctrine of discovery,” established a stark division between the civilized and uncivilized to rationalize, among other things, the theft of Indigenous people. This is a central argument of the book that signals how the civili zation project underpinning the territorial expansion of the United States was based on the transformation of commons into private property. Indigenous land became critical in the “political economy of plunder” advanced by the state and the meaning of “native” as a racial categorization of exclusion. Chapter 1 explores this economy of plunder by detailing the advancement of the settler frontier through different [End Page 139] mechanisms, such as the treaty policy— subsequently violated by the state— and territory surveying to make land legible for the state and cheap for settlers. It is worth mentioning that the book contains historical and thematic maps that visually represent the ideology of wilderness behind the colonization project and evidence of the territorial extent of dispossession suffered by Indigenous communities. However, this crusade to dispossess Indigenous peoples from their territory also rested on the national mythology that strengthened the trope of Indigenous vanishing. The author shows how during the years of the study, the Indigenous population was not vanishing but immersed in an intricate social world and transregional trade networks. Chapter 2 explores such context, following the story of an Ojibwe man to evidence the context in which settlers and federal officials relied on Indigenous customs to profit from the fur trade while using ties with communities to further land cessions.Mix- race families played a crucial role in expanding the settler frontier through treaty negotiations but remained marginalized as they identified themselves as both Natives and US citizens. This article makes the case for a specific variety of what we call Collective Capital Institutions (CCIs), by returning to the idea of Wage-Earner Funds (WEFs) – a 1970s Swedish policy proposal designed gradually to shift ownership and control over parts of the economy to democratically controlled institutions. We identify two attractive rationales in favour of such a scheme and argue that both can fruitfully be transposed to the current worldwide economic situation. The egalitarian rationale is that WEFs could (...) help in the pursuit of equality by giving a wider set of people a stake in collectively owned companies and a right to their profits. The democratic rationale is that WEFs redistribute not only these profits, but also the power over economic decisions made within companies. We then contrast such schemes for collective capital ownership with the similar but much more privatised proposals set out in, for instance, John Rawls's idea of a ‘property-owning democracy’. We argue that CCIs ultimately are more likely to contribute to the development of the ‘sense of justice’ within society that is needed for a stable just society. We conclude that CCIs deserve a great deal more exploration in academic and political discussions of egalitarian economic systems. (shrink)

This article examines the relationship between women entrepreneurs’ job autonomy and work–life balance, with a particular focus on how this relationship might be augmented by environments that discriminate against women, whether socio-economically, institutionally, or culturally. Multisource data pertaining to 5334 women entrepreneurs from 37 countries indicate that their sense of job autonomy increases the likelihood that they feel satisfied with their ability to balance the needs of their work with those of their personal life. This process is (...) particularly prominent when they operate in countries characterized by discriminatory socio-economic and institutional conditions, though a mitigating instead of invigorating effect arises in culturally discriminatory settings. For business ethics scholars and practitioners, these findings indicate how the extent to which women entrepreneurs, seeking to combine professional and private responsibilities, derive benefits from initiatives aimed at enhancing their job-related freedom critically depends on whether they operate in adverse external environments. The notion of a migration system is often invoked but it is rarely clearly defined or conceptualized. De Haas recently provided a powerful critique of the current literature highlighting some important flaws that recur through it. In particular, migration systems tend to be identified as fully formed entities, and there is no theorization as to how they come into being and how they break down. The internal dynamics which drive such changes are not examined. Such critiques of migration systems relate (...) to wider critiques of the concept of systems in the broader social science literature, where they are often presented as black boxes in which human agency is largely excluded. The challenge is how to theorize system dynamics in which the actions of people at one time contribute to the emergence of systemic linkages at a later time. This article focuses on the genesis of migration systems and the notion of pioneer migration. It draws attention both to the role of particular individuals, the pioneers, and also the more general activity of pioneering which is undertaken by many migrants. By disentangling different aspects of agency, it is possible to develop hypotheses about how the emergence of migrations systems is related to the nature of the agency exercised by different pioneers or pioneering activities in different contexts. One of the most significant changes in modern healthcare delivery has been the evolution of the paper record to the electronic health record (EHR). In this paper we argue that the primary change has been a shift in the focus of documentation from monitoring individual patient progress to recording data pertinent to Institutional Priorities (IPs). The specific IPs to which we refer include: finance/reimbursement; risk management/legal considerations; quality improvement/safety initiatives; meeting regulatory and accreditation standards; and patient care delivery/evidence based (...) practice. Following a brief history of the transition from the paper record to the EHR, the authors discuss unintended or contested consequences resulting from this change. These changes primarily reflect changes in the organization and amount of clinician work and clinician‐patient relationships. The paper is not a research report but was informed by an institutional ethnography the aim of which was to understand how the EHR impacted clinicians and administrators in a large, urban hospital in the United States. The paper was also informed by other sources, including the philosophies of Jacques Ellul, Don Idhe, and Langdon Winner. (shrink)

BackgroundThe trend toward open science increases the pressure on authors to provide access to the source code and data they used to compute the results reported in their scientific papers. Since sharing materials reproducibly is challenging, several projects have developed solutions to support the release of executable analyses alongside articles.MethodsWe reviewed 11 applications that can assist researchers in adhering to reproducibility principles. The applications were found through a literature search and interactions with the reproducible research community. An application was (...) included in our analysis if it was actively maintained at the time the data for this paper was collected, supports the publication of executable code and data, is connected to the scholarly publication process. By investigating the software documentation and published articles, we compared the applications across 19 criteria, such as deployment options and features that support authors in creating and readers in studying executable papers.ResultsFrom the 11 applications, eight allow publishers to self-host the system for free, whereas three provide paid services. Authors can submit an executable analysis using Jupyter Notebooks or R Markdown documents. All approaches provide features to assist readers in studying the materials, e.g., one-click reproducible results or tools for manipulating the analysis parameters. Six applications allow for modifying materials after publication.ConclusionsThe applications support authors to publish reproducible research predominantly with literate programming. Concerning readers, most applications provide user interfaces to inspect and manipulate the computational analysis. The next step is to investigate the gaps identified in this review, such as the costs publishers have to expect when hosting an application, the consideration of sensitive data, and impacts on the review process. The stated aim of many of the ‘memory museums’ which were established during this period is to invite reflection on the aestheticization of memory and on the fact that the exhibition is seen as a narrative which is challenging conventional codes of (...) perception. By granting a voice to what has been left out of the dominant discourses of history and of everyday experience, they try to integrate diversified and sometimes even incompatible narratives – a mode of representation that has so far been the domain of art and specifically literature. This contribution argues that it is not only between the museum and the memorial that distinctions between different memory media are getting blurred: examples such as Libeskind's Jewish Museum, which wants to be read as a text, and W.G. This article restores to us one of the manuscript collections of inscriptions compiled at the turn of the sixteenth century by Matteo Geronimo Mazza, a jurist, politician and scholar from Salerno. A prominent figure in Renaissance antiquarianism, Mazza compiled several epigraphic sylloges, which, together with his own collection of inscribed marbles, remained after his death in the villa he had built in Marechiaro at the edge of the bay of Naples, among the ruins of a Roman Temple of (...) Fortune and the ancient villa of Vedius Pollio. Most of Mazza’s manuscripts have long been considered lost. In the mid-nineteenth century, when Theodor Mommsen was compiling volume X of the Corpus Inscriptionum Latinarum, he searched unsuccessfully for Mazza’s sylloges, eventually making do instead with a set of eighteenth-century copies, which he found in the archives of Ludovico Muratori in Modena. One of Mazza’s manuscripts, however, had come into the hands of Sir William Hamilton, who, in 1801, donated it to the Society of Antiquaries in London. The recovery of this single epigraphic sylloge provides us with new information not only on Mazza himself but relating to inscriptions, monumental sites and sixteenth-century collections in southern Italy. The article also retraces the external history of the manuscript and the routes by which it left Naples for London, thereby revealing the dense network of eighteenth-century antiquarians who actively studied and copied materials preserved in Mazza’s villa, and shedding new light on some of his other sylloges, which are still lost. All these findings are additionally presented in tabular form at the end of the article in a series of Appendices, supplemented by Indices which group and distill the inscriptions themselves. This work aim to analyse relations between Arithmetic and Geometry indicated by Piero della Francesca in his treatise Libellus de quinque corporibus regularibus. Piero della Francesca was a painter and scholar of perspective, geometry and arithmetic, in his time. He carried out investigations on pictorial, geometric and architectural issues. Of the treatises he wrote, only three are preserved, on perspective, Geometry and Arithmetic. The central document selected for this research was the manuscript Libellus de quinque corporibus regularibus, (...) deposited in the Vatican Apostolic Library in digitized copy. Throughout this work we have tried to understand the Libellus de quinque corporibus regularibus as a result of the work of an artist and scholar who proposed ways of relating Arithmetic and Geometry using both his practical knowledge and the works of authors of antiquity. Work has always been a significant source of ethical questions, philosophical reflection, and political struggle. Although the future of work in a sense is always at stake, the issue is particularly relevant right now, in light of the advent of advanced AI systems and the collective experience of the COVID-19 pandemic. This has reinvigorated philosophical discussion and interest in the study of the future of work. The purpose of this survey article is to provide an overview of the (...) emerging philosophical field that engages with the future of work, with a special focus on equality and justice, and to outline a research agenda that can help the field to develop further. Section 2 provides some historical context for the current surge in interest in the topic. Then, we discuss what work is and whether there is a philosophy of work (Section 3). The four main sub-debates we then turn to concern the value of work (Section 4), distributive justice and work (Section 5), productive justice (Section 6), and institutional reforms prompted by changes in how work is organized (Section 7). The final section discusses the importance of the distinction between ideal and non-ideal theory in philosophical investigations into the future of work. (shrink)

This paper addresses the question of whether and how public action via civil society and/or government can meaningfully shape industry-wide corporate responsibility behaviour. We explore how, in principle, ICR can come about and what conditions might be effective in promoting more ethical behaviour. We propose a framework to understand attempts to develop more responsible behaviour at an industry level through processes of negotiation and coalition building. We suggest that any attempt to meaningfully influence ICR would require stakeholders to possess (...) both power and legitimacy; moreover, magnitude and urgency of the issue at stake may affect the ability to influence ICR. The framework is applied to the retail banking industry, focusing on post-crisis experiences in two countries—Spain and the UK—where there has been considerable pressure on the retail banking industry by civil society and/or government to change behaviours, especially to abandon unethical practices. We illustrate in this paper how corporate responsibility at the sector level in retail banking is the product of context-specific processes of negotiation between civil society and public authorities, on behalf of customers and other stakeholders, drawing on legal and other institutions to influence industry behaviour. The historiographic tradition of the history of science that originated with Auguste Comte bears all the marks of narratives with roots in the Enlightenment, such as a view of religion as an underdeveloped stage in the ascending road in humanity's quest for a more mature understanding. This article explores the development of the peripheral branch of a tradition that developed in Argentina by the mid‐twentieth century with authors such as the Italians Aldo Mieli, José Babini, and the Hungarian Desiderius (...) Papp. It is argued that, contrary to the historiographic program of the conflict thesis developed in English‐speaking countries, those scholars who cultivated the kind of “positivist” history of science that thrived in continental Europe were inclined to see science as a social and epistemological replacement of a fossilized religious outlook. In the final section, I suggest a way to relate the more or less strong versions of the conflict thesis to different patterns of secularization. (shrink)

Max Stirner is generally considered a nihilist, anarchist, precursor to Nietzsche, existentialism and even post-structuralism. Few are the scholars who try to analyse his stands from within its Young Hegelian context without, however, taking all his references to Hegel and the Young Hegelians as expressions of his own alleged Hegelianism. This article argues in favour of a radically different reading of Stirner considering his magnum opus “Der Einzige und sein Eigentum” as in part a carefully constructed parody of Hegelianism (...) deliberately exposing its outwornness as a system of thought. Stirner's alleged Hegelianism becomes intelligible when we consider it as a formal element in his criticism of Bauer's philosophy of self-consciousness. From within this framework it becomes quite clear what Stirner meant with such notions as “ownness” and “egoism”. They were part of his radical criticism of the implicit teleology of Hegelian dialectics as it found according to him its highmark in Bauer. In short, this article puts the literature on Stirner into question and tries for the first time in 30 years to dismantle Stirner's entire undertaking in “Der Einzige und sein Eigentum” by considering it first and foremost a radical criticism of Hegelianism and eventually the whole of philosophy while fully engaged in the debates of his time. ☆ The author would like to thank Douglas Moggach for corresponding with me on the idea of the comic and for not sparing me his “critical criticism” in general. Therefore, in many cases it is rational to rely on experts since in many cases the fact that an expert says that p makes it highly likely that p is true. I will defend this claim by providing 5 arguments that illuminate and elaborate on 5 crucial claims about expertise. Like Nietzsche, he also possessed a gift for acidic analogy and likened the world of academia to a group of dogs (...) sniffing one another.Few observers of the academic interactions of his time had such sharp senses as Pierre Bourdieu, and few have been as torn between solitary reflection and communal exchange. This paper contends that the identification of a pro-competitive agenda in the process of regulatory reform undertaken in many developing countries ultimately rests on the vision held by the authority about the sources of market failures. Conventional IO theory rests on the assumption that the exercise of market power by incumbent firms limits the access of potential competitive entrants, and therefore, regulation should curb such power. However, the existence of market power is an inference from conventional thinking on markets (...) and competition. Professor Kirzner overturned this thinking, by introducing a realistic process perspective of markets, instead of the traditional structural view. Beyond the philosophical question of “realism,” the market process view sustains practical policy making advantages, mostly due to the lack of knowledge requirements placed upon the regulatory agencies to allocate resources more efficiently. The process view suggests the need of creating a proper institutional setting for firms to freely interact, rather than on impinging in the allocation of resources itself according to unreliable contrived views of market efficiency. Based on Kirzner´s process view, this paper outlines an alternative network competition perspective, focused on the integration of complementary capabilities, as a regulatory yardstick. This view balances the rights of incumbent firms to exploit their rights, and the possibilities of third parties to integrate into the network concerned on a non-discriminatory basis, thereby preserving the investments of incumbents on a more equitable basis.Cet article affirme que l’agenda proconcurrentiel de réforme réglementaire entrepris dans plusieurs pays en développement repose en fin de compte sur la vision qu’a l’autorité concernant les échecs de marché. La théorie conventionnelle d’organisation industrielle suppose que l’exercice du pouvoir marchand par les firmes existantes limite l’accès de concurrents potentiels et, qu’en conséque- nce, la réglementation devrait brider ces pouvoirs. Cependant, l’idée qu’il existe un pouvoir marchand est une émanation de la pensée conventionnelle à propos des marchés et de la concurrence. En opposant une vision réaliste du processus marchand à la vision structurelle traditionnelle, le Professeur Kirzner a réduit à néant ce mode de pensée conventionnelle. Audelà de la question philosophique du “réalisme”, la vision procédurale de marché affirme que la politique de réglementation est un échec car les agences de réglementation ne disposent pas des connaissances nécessaires requises pour affecter les ressources de manière efficace. La vision procédurale suggère le besoin de créer un environnement institutionnel dans lequel les entreprises peuvent interagir entre elles plutôt que d’empiéter sur l’affectation des ressources en ellemême comme le suggère la perspective artificielle et peu fiable de l’efficacité marchande. Se fondant en cela sur la vision procédurale de Kirzner, cet article ébauche une perspective différente du réseau concurrentiel dont l’étalon est l’intégration des capacités complémentaires. Dans cette vision, les droits des firmes existantes à exploiter leurs droits ont comme contrepoids les possibilités de tierces parties à s’intégrer dans le réseau concerné sur une base nondiscriminatoire, préservant ainsi les investissements des entreprises existantes suivant une base plus équitable. Altiero Spinelli (1907-1986) is worldwide renowned as the principal author (with Ernesto Rossi) of the Ventotene Manifesto (1941), whose second edition (1944), prefaced by Eugenio Colorni, is one of the founding documents of the European Union. Less known is the width and depth of Spinelli's thought, not only as a political theorist of supra-national democracy and institutional designer of a possible European Federation but also as a philosopher of civilization and history. While the sources of his federalism have been (...) largely investigated, much less have those of his more comprehensive philosophy. This paper discusses, on a philological basis, the dialogue Spinelli certainly has with some of Max Scheler's writings while going into this dialogue more in-depth, in a philosophical more than philological attitude. Abstract Our growing demand for meat and dairy food products is unsustainable. It is hard to imagine that this global issue can be solved solely by more efficient technologies. Lowering our meat consumption seems inescapable. Yet, the question is whether modern consumers can be considered as reliable allies to achieve this shift in meat consumption pattern. Is there not a yawning gap between our responsible intentions as citizens and our hedonic desires as consumers? We will argue that consumers (...) can and should be considered as partners that must be involved in realizing new ways of protein consumption that contribute to a more sustainable world. In particular the large food consumer group of flexitarians offer promising opportunities for transforming our meat consumption patterns. We propose a pragmatic approach that explicitly goes beyond the standard suggestion of persuasion strategies and suggests different routes of change, coined sustainability by stealth, moderate involvement, and cultural change respectively. The recognition of more routes of change to a more plant-based diet implies that the ethical debate on meat should not only associate consumer change with rational persuasion strategies and food citizens that instantiate “strong” sustainable consumption. Such a focus narrows the debate on sustainable protein consumption and easily results in disappointment about consumers’ participation. A more wide-ranging concept of ethical consumption can leave the negative verdict behind that consumers are mainly an obstacle for sustainability and lead to a more optimistic view on modern consumers as allies and agents of change. This paper suggests that the time for free inquiry and academic freedom at European universities has rarely been better than at present, that debates and results arising from independent scientific discourse have rarely had better chances of blossoming and evoking a response than in the time in which we now live, and that the basic rules of university and scholarly work in general are, by no means, seriously threatened in Europe, in comparison to many other regions of the world. (...) What I see is that universities now, more than ever, have the chance and the obligation to discharge their duties at the centre of society. Universities are needed and respected - and with them the principles of the university that this paper describes and elaborates. These principles are recognized by society as a whole as the prerequisites for a successful response. This is the age of the universities - now, more than ever. (shrink)

PurposeThe purpose of this study is to illustrate how the adoption of new enterprise resource planning systems affects sensemaking in the process of Organizational Identity integration after a Merger and Acquisition.Design/methodology/approachWithin a wider case study about an acquisition in chemical/pharmaceutical industry, the paper describes the effects of SAP adoption and implementation on the organizational identity. This methodology, based on semi‐structured interviews to project leaders and to team members, has allowed a deep comprehension of the context, even if results (...) cannot provide statistical evidence of relationships.FindingsUsing the Swanson and Ramiller's approach to innovation, the paper argues that ERP adoption and implementation support sensemaking process if innovation takes place with mindfulness and because, in that case, people interact on symbolic meanings sharing retrospective knowledge and cognitive causal maps. After an M&A there are conditions for a mindful innovation with IT and therefore innovating with IT can be an effective way to enforce sensemaking process and, as a consequence, to influence the Organizational Identity evolution. In a constructionist approach, the evolution of organizational identity requires a social negotiation among members where sensemaking has a primary role. So, the integration process following acquisitions can be facilitated by adopting, implementing and assimilating common IT solutions with mindfulness.Research limitations/implicationsThe first limitation of this study is referred to timing. The author entered into the company within a year after the acquisition and went out at the beginning of SAP assimilation phase. Therefore, some perceptions could still evolve in different ways. The second limitation depends on the fact that the author analyzed a single case. By focusing on one case of acquisition – an acquisition that gives value to acquired company – the author might be limiting the transferability of the findings.Practical implicationsThese results can be useful for both scholars and practitioners. Managers who face organizational change can consider the adoption and implementation of ERP as an opportunity to influence the evolution of Organizational Identity according to strategic priorities.Originality/valueThe value of this study is in its approach that links a strategic level with a social level. The authors investigate MacCormick and Weinberger's claim that the Institutional Theory of Law provides a conceptual framework for the study of legal phenomena from a socio-legal point of view. They evaluate this claim by confronting both the Institutional Theory of Law and Weinberger's theory of action with two approaches in socio-legal theory, i.e. the instrumentalist and the constitutive approach. The conclusion is that the Institutional Theory of Law lends itself to empirical research from an instrumentalist perspective, for both place (...) the concept institution in the context of law. Weinberger's theory of action may provide a basis for empirical research from a constitutive perspective. The authors make some suggestions for refinement of Weinberger's theory of action in order that the relation between institutions and action can be labeled dynamic. (shrink)

The well-established pattern of Executive expansionism and limited oversight of Executive action in times of terrorism is problematic from the civil libertarian point of view. How to limit such action has been the subject of much scholarship, a large amount of which focuses on perceptions of institutional competence rather than effectiveness. For the authors, the effective control of security-focused state action is to be judged by the extent to which it consists only of action that is necessary and proportionate and (...) thereby strikes an appropriate balance between security exigencies and individual rights. This article, written and structured in dialectic form, presents competing perspectives on effective oversight mechanisms: on the one hand, an extra-constitutionalism perspective, proposing a limited role for the Judiciary and emphasizing the need for legislative and democratic controls; and on the other, an argument for judicial muscularity. The characterisation of anthropogenic climate change as a violation of basic human rights is gaining wide recognition. Many people believe that tackling this problem is exclusively the job of governments and supranational institutions (especially the United Nations Framework Convention on Climate Change). This argument can be traced back to the delegated authority model, according to which the legitimacy of political institutions depends on their ability to solve problems that are difficult to address at the individual level. Since the (...) institutions created to tackle climate change fail to do so, their legitimacy is under great pressure and can only be saved by considerations of feasibility. We argue that democratically elected representatives are able to claim that a more robust climate policy is unfeasible, but only because the mandate we as citizens grant them is very restrictive. Instead of shifting responsibility for the thoroughly inadequate response to climate change fully to political representatives, we should highlight the failure of the political community as a whole to fulfil its responsibility at the input-side of the delegation of authority. When individual voters fail to fulfil the minimal obligation to at least vote for parties that explicitly advocate robust climate policies, they cannot hide behind the delegated authority argument, but should accept their complicity in the massive violations of basic human rights caused by the failure to successfully tackle climate change. We read commentaries on our feature article ‘The ethics of consent during labour and birth: episiotomies’1 with gratitude and interest. Nearly all commenting authors agree that consent for in-labour procedures is necessary and ideally given at the point of intervening. Both Shalowitz & Ralston and Stirrat note that this is already required by professional statements and guidelines in the USA2 and UK3, respectively, but also note that practice does not yet conform. The Americans authors helpfully emphasise the importance of (...) multilevel institutional measures for closing this gap, including consent policies and reporting mechanisms, as well as ongoing education.2 The UK writer seconds the role for education within wider shared decision-making and informed choice approaches, and generously commends our paper for close study by all maternity care providers. Others add a cautionary note. Lee applauds all our recommendations, but notes our proposals cannot fully secure autonomy because of, among others, epistemic injustice and other power differentials.4 Kumar-Hazard and Dahlen worry that opt-out consent is equal to substitute decision-making; weakens women’s rights; and is open to abuse.5 Nelson and Clough object to our willlingness to work within a flawed conceptual framework, which ought to be challenged.6 We agree that there are limits to what our proposal can do. It cannot rectify unequal distributions of epistemic credibilities, either in general or in any particular interaction.
